Hello Team .

  Pls share be the procedure /requirment related to Hazardous chemical management. 

  As part of my organisation, we have to import chemicals for the process requirment.

 option 1 : directly from countires like thailand,china,france

 Option 2 : from the suppliers who supplies imported chemicals.

 I have gone through - MIHSC rules 1989 & 2000.

Pls tell me in a nut-shell what are the things i  have to do as a company.

And what are the things i have to check if i have to buy from the local suppliers as per env.regulations

My idea is to 100 % comply with legal requirment and put in place sound environment practice

  • I think Upasana has summarized whatever forms you need. Just want to add that in addition to the imports, if you would be storing in your factory/unit, you need to comply not only with MSIHC Rules 2000 but other related statutes such as Petroleum Act/Rules wherever applicable. This is only a general suggestion.

  • You need to meet requirements under MSIHC Rules as you rightly mentioned. MozEF had been working at Draft Hazardous Substances (Classification Packaging and Labelling) Rules 2011 whch, if already notified, would also apply to you. Till recently it was not notified. I am not aware of the status now.

    Here is a summary of MSIHC requirement:

    • Under Section 18 (2) of the said rule, it is stated that any person responsible for importing hazardous chemicals in India shall provide the time of import or within thirty days from the date of import to the concerned authorities as identified in Column 2 of Schedule 5 the information pertaining to,
      • Name and Address of the person receiving the consignment in India;
      • The port of entry in India;
      • Mode of transport from the exporting country to India;
      • The quantity of chemical(s) being imported; and
      • Complete product safety information.
    • Under Rule 18(5), fill in Schedule 10 - FORMAT FOR MAINTAINING RECORDS OF HAZARDOUS CHEMICALS IMPORTETD

      1.Name and Address of the Importer:

      2.Date  and reference number of issuance of permission to import hazardous chemicals:
      3.Description of hazardous chemicals:
      a)Physical form
      b)Chemical Form
      c)Total volume and weight (in kilograms/Tonnes)
      4.Description of purpose of Import:
      5.Description of storage of hazardous Chemicals:
      a)Date:
      b)Method of Storage
  • Pl.z do go through Haz. Waste (Management, Handling & Transboundary Movement) Rule 2008. If u have some chemicals /waste above the limit given then kinldy apply to ur respective pollution Control Board in Form-I with fee. (u may apply for 5 years too depend upon pollution Control Board) after ur application Pollution Control Board issue a Haz. Waste Authorization and u have to comply tht with in a year by sending a compliance report. Also Annualy u have to submit Haz Waste Return to respective pollution control board. now with tht if u sell/buy any haz chemical, waste etc. u have fill manifest Form-13 (six color form) and send white color to pollution control board along with return form.

  • First check as per MSIHC rule ,are you  improting hazardous chemicals? if yes,then you need to inform to SPCB about improrted chemical . Please ref rule 18.
