URGENT - Can anyone please clarify

this is for a project having stretches of elevated corridors and at grade roads. this falls neither under state highways nor national. can this be covered under section 8 of the notification - construction projects with facilities open to sky

    sorry being late. by now you might have applied for EC also. By interpretation of EIA notification schedule-1 8(a) , your project require EC as the facilities open to sky , if the activity area more than 20000 Sq.M. Thsi is the way MOEF interpret. I agre with Prof Pillai that the main contention on deciding EIA should not be by law alone but by the anticipated impacts. thsi some how never percolated in India due to Failure of MOEF acting as technical body and tend to behave as technical babus.
  • I do agree with Jomcy.The explanation given by him in itself is quiet explanatory.Regarding Road projects,there are flaws in EIA Notification.It requires a lot of constrctive amendments.2006 EIA Notification is silent on some of the road projects and their categorisation.
