As per the MoEF office Memorandum dated 22/03/2010 (Validity of the ToR), validity period of primary data depends of the approval of ToR for that project.
1) If you receive ToR before above said notification, primary data is valid for 3 years to submit your EIA/EMP report to get EC after Public Hearing if required.
2) If you receive ToR after above said notification, your ToR is valid for 2 years from the date of issue. This may be extended to 3 rd year, based on project justification, approval of EAC/SEAC.

Dear Mr Sultan,
MoEF is making everyone work for OMs these days. They do not bother to circulate anything. To my knowlege finding out a 'circular' in its actual meaning is likely to be difficult. You can look for information on MoEF's website under the clearance url where they have uploaded these subtee refuge OMs under head of "EIA related circulars".
Validity actually depends on the agency validating the data, for example we use atmospheric data for yester years from Met Dept. Here, such data cannot have any period of validity because in our country January will never see 40 degrees Celsius or Monsoon will never have winds from North, it is as natural as that.
We have got eminent acadamically powerful personalities in the forum and they can always guide us better.
