Applicability of Environmnetal Laws in sea away from 12 NM from nearest shore / land

Dear All,

Would appreciate your experience and knowledge on applicability of environmental laws in India for facilities outside 12 Nautical miles in the sea.

If I am having a facility of exploration in sea at a distance more than 12 NM away from the nearest shore base, do I need to follow the Environmental laws of India.  If yes, kindly provide the information regarding the same.

Does EPA act, 1986  is applicable??

Do I need to monitor water quality, ambient air, noise etc.,

    EPA 1986 is umbrella act & it is applicabe to all environmental issues.Have a look on costal regulation zone notification 2011.Hope this will satisfy your Quieries.

    According to the International Environmental Law after 12 NM is SEZ special economic zone , here you will have to follow the International Maritim guidelines, and in case of India there are special guidelines which  need to follow and it depend on the activity you are doing or any research!!!

    EPA act would be applicabale in terms of obtaining environmental clearance for offshore activities, though EIA notification doesn't specify the distance of offshore activities. If it involves international borders than clearances from the respective governments would be required. If exploration is within indian waters then clearance from ministry of defence, external affairs, etc is mandatory

    Pls. refer EIA notification (Revised) 2006, and Coastal Management Zone Notification (Revised - Draft recirculated), and EPA (1986). You shall get all the details on requirments and procedures.

    As far as my knowledge goes, I think you do need the clearance because it would be considered India territory
